AGREEMENT TO TERMS

These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and DeepTest ("Company," "we," "us," or "our"), concerning your access to and use of our software-as-a-service platform and related services (the "Service").

By accessing or using the Service, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, then you may not access the Service.

SUBSCRIPTION TERMS

Access to the Service requires a paid subscription. Subscription fees are based on your selected plan and are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law or as explicitly stated in these Terms.

Free Trial: We may offer a free trial period for new accounts. At the end of the trial period, your account will automatically convert to a paid subscription unless canceled before the trial period ends.

ACCOUNT REGISTRATION

You must register for an account to access the Service. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account.

ACCEPTABLE USE

You agree not to:

- Use the Service for any illegal purpose or in violation of any laws

- Interfere with or disrupt the integrity or performance of the Service

- Attempt to gain unauthorized access to the Service or related systems

- Upload or transmit malicious code or content

- Use the Service to store or transmit infringing, libelous, or otherwise unlawful material

- Reverse engineer, decompile, or disassemble any portion of the Service

INTELLECTUAL PROPERTY RIGHTS

The Service and its original content, features, and functionality are and will remain the exclusive property of DeepTest and its licensors. The Service is protected by copyright, trademark, and other laws.

Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

YOUR CONTENT

You retain all rights to any content you upload to the Service. By uploading content, you grant us a worldwide, non-exclusive license to use, store, and process that content solely for the purpose of providing the Service.

You represent and warrant that you have all rights necessary to grant us these rights and that your content does not violate any laws or rights of any third party.

DATA SECURITY AND PRIVACY

We implement reasonable security measures to protect your data. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

SERVICE AVAILABILITY AND SUPPORT

We strive to maintain 99.9% uptime but do not guarantee uninterrupted access to the Service. We may schedule maintenance windows during which the Service may be unavailable.

Technical support is provided according to your subscription plan. Response times are not guaranteed unless explicitly stated in a separate Service Level Agreement.

TERMINATION

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms.

Upon termination:

- Your right to use the Service will immediately cease

- We will provide you with the ability to export your data for 30 days

- After 30 days, we may delete your data from our systems

LIMITATION OF LIABILITY

IN NO EVENT SHALL DEEPTEST BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN ANY WAY CONNECTED WITH YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO US FOR USE OF THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE INCIDENT GIVING RISE TO THE CLAIM.

INDEMNIFICATION

You agree to indemnify and hold DeepTest harmless from any claims, losses, damages, liabilities, including legal fees and expenses, arising out of your use or misuse of the Service, violation of these Terms, or violation of any rights of a third party.

MODIFICATIONS TO THE SERVICE

We reserve the right to modify or discontinue, temporarily or permanently, the Service with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

CHANGES TO TERMS

We reserve the right to update these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last Updated" date.

Your continued use of the Service after any changes constitute your acceptance of the new Terms.

GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of [Jurisdiction], without regard to its conflict of law provisions.

DISPUTE RESOLUTION
